Mainboard-listed LMA International NV says the US Court of Appeals for the Federal Circuit dismissed the federal district court’s order that Ambu’s AuraOnce, Aura40, and AuraStraight do not infringe LMA’s US Patent No. 7,156,100.
The appellate court also dismissed the district court’s order that patents were invalid for lack of a written description. Since those two orders were the only grounds for the trial court’s judgment, the appellate court has remanded the case to the district court for further proceedings.
Ambu may petition for reconsideration of the appellate court’s decision within 30 days. Ambu may seek review in the US Supreme Court within 90 days of the appellate court’s decision.
